Door een ernstige storing bij de beheerder van rechtspraak.nl functioneren de deeplinks naar de op rechtspraak.nl gepubliceerde uitspraken nog altijd niet. Nader bericht volgt zodra het euvel is hersteld (op email en telefoon wordt helaas niet gereageerd bij rechtspraak.nl).

Wie nog een relevante uitspraak op de plank heeft liggen mag deze vanzelfsprekend mailen. Zonder jurisprudentie is het tenslotte niets gedaan, dat hele IE-recht.   

From Distribution to Dialogue: Remarks on the Concept of Balance in Copyright Law. CIER-Lecture by Abraham Drassinower; Associate Professor at the Faculty of Law, Chair in the Legal, Ethical and Cultural Implications of Technological Innovation, and Director of the Centre for Innovation Law and Policy, University of Toronto.

Abstract: Few propositions are more frequently asserted in contemporary copyright discussion than the proposition that copyright is a balance between authors and users - a balance (as some like to say) between the incentive to create and the imperative to disseminate works of authorship.

The paper argues (a) that the concept of balance cannot support the weight it is asked to bear in copyright jurisprudence, and (b) that we should think of copyright less as a "balance" between authors and users than as a "dialogue" between authors and users.  In short, "dialogue" is a metaphor more appropriate than "balance" to structure our interpretation of copyright law and of its purpose. 

On the basis of the idea of dialogue, the paper offers an understanding of certain copyright exceptions rather as user's rights integral to the copyright system; inquires into the lawfulness of copying for personal use; and suggests a concept of the public domain less as a matter of values or weights to be placed on a balance, than as a site of and condition for a network of communicative acts in which both authors and users participate.

De muziek zal verzorgd worden door het gehele kantoor van Van Heemstra Bakker, met wellicht wat aanvulling (mondharmonica mag mee). Deo volente staan er voor de gesprekken een achterbank en een aantal comfortabele sterk uitvergrote hoofdkussens met brede randen en grote labels.

It was a natural choice for UNESCO's General Conference to pay a world-wide tribute to books and authors on this date, encouraging everyone, and in particular young people, to discover the pleasure of reading and gain a renewed respect for the irreplaceable contributions of those who have furthered the social and cultural progress of humanity.”

“A City trader is being investigated by police in connection with a bogus website that appealed for cash to help to find Claudia Lawrence, the chef who went missing two weeks ago in York. The Observer can reveal that Maichel Los, a 39-year-old Dutchman, is also behind a complex web of internet companies and domain names asking the public to contribute to worthy causes.

Los, who lives in west London, has used a foreign company to create websites bearing the names of famous pop stars and registered scores of internet domain names, many relating to leading figures in the worlds of art and religion.

(…) Attention has now switched to Los's alleged role in constructing the site and his registration of scores of other websites. Internet domain name searches reveal that he uses a number of pseudonyms, including "Dries Coms" and "Norbert Van Vaalsen". He reportedly calls himself "Los Bol" on social networking sites such as Myspace. "Los Bol" is Dutch for someone with no moral scruples.
